1. Agreement to Terms
By accessing or using MyMagicAlerts (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.
MyMagicAlerts is operated by IO Software Solutions LLC d/b/a IO Mobile Labs (“Company,” “we,” “us,” or “our”), a single-member LLC. The Service is available at mymagicalerts.com and related subdomains.
2. Disney Disclaimer
MyMagicAlerts is an independent service and is not affiliated with, endorsed by, authorized by, or sponsored by The Walt Disney Company, Walt Disney Parks and Resorts, or any of their subsidiaries or affiliates.
Walt Disney World®, Magic Kingdom®, EPCOT®, Hollywood Studios®, Animal Kingdom®, and all related marks, characters, and intellectual property are the exclusive property of The Walt Disney Company.
We monitor publicly available dining reservation availability on behalf of our users. We make no guarantees regarding the accuracy, timeliness, completeness, or continued availability of any reservation data. Disney may change reservation systems, availability, policies, or park operations at any time without notice, and such changes are entirely outside our control.
We are not responsible for:
- Missed reservations due to data delays, inaccuracies, or system outages
- Changes to Disney’s reservation systems or policies
- Park closures, reservation cancellations, or capacity changes by Disney
- Any losses, costs, or damages arising from reliance on our alerts
Use of this Service does not guarantee you will obtain a dining reservation at Walt Disney World.
3. We Do Not Hoard, Scalp, or Sell Reservations
MyMagicAlerts is a monitoring and notification tool only. We do not, and will never, hold, hoard, scalp, broker, resell, or profit from Walt Disney World dining reservations.
To be absolutely clear:
- We never book or hold reservations on your behalf, our own behalf, or anyone else’s.
- We never acquire reservations in order to resell them at a markup or for any other purpose.
- We never sell, transfer, broker, or trade reservations to you or to any third party.
- We do not interfere with, reduce, or compete for the availability that all guests share.
All we do is watch publicly available reservation availability and notify you when a table you are looking for opens up. You book it yourself, directly with Disney, on the same terms as any other guest and at no additional reservation cost from us.
4. Eligibility
You must be at least 18 years old to use this Service. By using the Service, you represent that you meet this requirement. We do not knowingly provide services to minors.
5. Account Registration
5.1 Account Creation
You may register using Google, Apple, or a magic link sent to your email address. You are responsible for maintaining the security of your account access.
5.2 Accurate Information
You agree to provide accurate information when registering and to keep your contact information current. Inaccurate information (particularly your email or phone number) may result in missed alerts.
5.3 Account Security
You are responsible for all activity that occurs under your account. Notify us immediately at support@mymagicalerts.com if you suspect unauthorized access.
5.4 One Account Per Person
You may not create multiple accounts to circumvent plan limits or restrictions. We reserve the right to merge or terminate duplicate accounts.
6. Free and Paid Plans
6.1 Free Plan
We offer a free tier with limited features. Free plan features, limits, and availability are subject to change at our discretion with reasonable notice.
6.2 Paid Plans
Paid subscriptions are billed on the terms presented at checkout (monthly or annually). All payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method.
6.3 Pricing Changes
We may change subscription pricing with at least 30 days’ advance notice. Continued use after the effective date constitutes acceptance of the new pricing.
6.4 Cancellation
You may cancel your paid subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial periods.
6.5 Refunds
All sales are final except where required by applicable law. If you believe you were charged in error, contact us at support@mymagicalerts.com within 30 days of the charge.
6.6 Failed Payments
If a payment fails, we will attempt to retry the charge. If payment is not resolved within a reasonable period, your account may be downgraded to the free plan or suspended.
7. Alert Delivery
7.1 Delivery Methods
We offer alerts via email, SMS/text message, and webhook. Delivery method availability may vary by plan.
7.2 No Delivery Guarantee
We do not guarantee delivery of any alert. Alerts may be delayed, undelivered, or inaccurate due to technical issues, third-party service failures, network conditions, or changes in Disney’s reservation systems.
7.3 SMS Messaging
By providing your phone number and opting in to SMS alerts, you consent to receive text messages from MyMagicAlerts. Message and data rates may apply. You may opt out at any time by replying STOP to any SMS or updating your notification preferences in your account settings. No mobile information will be shared with third parties for marketing purposes.
7.4 Webhooks
Webhook delivery is provided as-is. We are not responsible for failures caused by your endpoint being unavailable, misconfigured, or rate-limiting our requests.
7.5 Alert Accuracy
Reservation availability data is sourced from publicly available systems and reflects conditions at the time of detection. By the time you receive an alert and attempt to book, the reservation may no longer be available. This is inherent to the nature of real-time reservation monitoring and does not constitute a Service failure.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to automate bookings in violation of Disney’s terms of service
- Resell alerts or account access to third parties
- Scrape, copy, or redistribute our data
- Interfere with or disrupt the Service or its infrastructure
- Attempt to circumvent plan limits through technical means
- Use the Service to harass, harm, or deceive others
We reserve the right to suspend or terminate accounts that violate these terms.
9. Intellectual Property
All content, branding, code, and design of MyMagicAlerts is owned by IO Software Solutions LLC d/b/a IO Mobile Labs or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.
Disney trademarks, characters, and related intellectual property referenced on this Service are the property of The Walt Disney Company and are used solely for descriptive purposes to identify the subject matter of our Service.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Alerts will be accurate, timely, or complete
- Any specific reservation will be obtainable through use of the Service
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IO SOFTWARE SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, TRAVEL COSTS, OR MISSED RESERVATIONS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless IO Software Solutions LLC d/b/a IO Mobile Labs, its members, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party’s rights.
13. Third-Party Services
The Service integrates with or links to third-party services including Stripe (payments), Google and Apple (authentication), and SMS providers. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of any third-party service.
14. Termination
We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
Upon termination, your right to use the Service ceases immediately. Sections 2, 3, 9, 10, 11, 12, and 15 survive termination.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of West Virginia, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved informally by contacting us at support@mymagicalerts.com. If not resolved within 30 days, disputes shall be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in West Virginia or remotely.
You waive the right to participate in a class action lawsuit or class-wide arbitration.
16. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after the effective date of updated Terms constitutes your acceptance.
